In principle, direct infringement of a patented method requires a single actor to perform all of the steps of the patented method. However, in recent years, multiple computers on a network often work together to provide services. The questions arises as to whether infringement occurs when the method is performed by multiple agents, or an entity performing some of the steps is located overseas. Lately, the Japanese Intellectual Property High Court made a judgement in relation to extraterritorial application for a system invention, and it has been a hot topic. In this seminar, I will give you an overview of patent infringement by multiple participants and extraterritorial application in Japan.
