“Medical activity” normally practiced by medical doctors is an ineligible subject matter. In addition, a patent right for a medical invention that is to be manufactured by mixing two or more medicines together has no effect against the act of preparing a medicine as per a doctor’s prescription. For the sake of smooth implementation of medical practices by doctors, there are some exemptions in the Japanese Patent Law. This time, the Intellectual Property High Court (IPHC) issued a landmark decision in a dispute over patent infringement related to a cosmetic breast augmentation procedure. In this presentation, we would like to explain this case law while confirming some exemptions for bio/pharma inventions in the Japanese Patent Law.
