Outline of the Webinar
The Japanese Trademark Law has been revised and letters of consent will be available. The revision will come into effect on April 1, 2024. The examination guidelines on letters of consent have not been finalized by the Japan Patent Office yet. However, it would be useful to know how the practice of letters of consent could be in Japan well before April 1, 2024.
Mr. Tomohiro Gyoda, who is well experienced in negotiations with the owners of prior marks on coexistence, will explain the letter of consent system based on the draft of the examination guidelines and the pros and cons of letters of consent and temporary assignments (so-called “assign-back arrangement”), which have been traditionally used instead of letters of consent.
