According to the Japanese Patent Law, computer programs, etc. are included among statutory inventions. Since computer programs have characteristics that tangible objects do not have, protection has been achieved under the Law since 2002. A “program, etc.” means a “program” and “other information supplied for processing by the computer and equivalent to the program”, for example, a data structure according to the JPO Examination Handbook. More than 2,600 patent applications filed with data structure claims can be found on the JPO website. A data structure claim should not be simply a set of data elements, but it has to define the processing of a computer, in order to be equivalent to a computer program. I will explain the basic concept of data structure claims, some examples in the JPO Examination Handbook, and some examples from among actually granted claims.
