Comments from Speaker
Once a patent is granted in Japan, the claims can be revised only through a correction, which is generally considered to be permitted within a much narrower scope than an amendment during examination. For this reason, correction has often been perceived as being of limited practical use. A typical example is the question we frequently receive from overseas: “Can the claims be amended after the Notice of Allowance?” The usual answer has been that no amendment is possible after the Notice of Allowance, and that a divisional application should be filed instead, given the risk that a correction may not be accepted. But how narrow is the scope of correction in actual practice? In this seminar, we will answer this question using statistics on recent decisions on trials for correction and case studies mainly from the software, electrical, and mechanical fields, while sharing practical considerations for choosing between a divisional application and a correction.
