Comments from Speaker

Patent eligibility in Japan is said to be more relaxed than in other jurisdictions. Nevertheless, there are some important points to consider in order to satisfy patent eligibility and other description requirements when drafting specifications and claims for software and business-related inventions.
In the past, the IP High Court was very strict for patentees in infringement lawsuits, in particular, for software-related inventions. However, the number of cases in favor of plaintiffs has recently been increasing.

Some tips for prosecution as well as some examples of winning cases and points for succeeding in infringement lawsuits will be introduced.
