In network-related inventions, part of network entities, such as servers, is often located outside of Japan. However, according to the principle of territoriality, the working act of a patented invention must be performed in Japan. The question arises as to whether infringement occurs when a part of the invention is implemented abroad. Lately, the Japanese Intellectual Property High Court made two important decisions in relation to this issue. In this seminar, we will introduce suggestions for the concept of cross-border implementation of inventions from these case studies in Japan.
