The Japan Patent Office has revised the Patent Examination Guidelines. The revised guidelines apply to examinations conducted on or after July 1, 2026. This webinar covers the two changes most relevant to foreign applicants: the revised approaches to examining the inventions regarding inventive step and disclaimers. Regarding inventive step, we will explain how obstructive factors or “teaching away” are weighed based on their degree. Regarding disclaimers, how new matter issues and inventive step are evaluated will be discussed in comparison with foreign practice. We will also introduce a relevant Japanese IP High Court decision to help attendees understand how these standards are applied in practice.
